Former BSI banker Yeo faces two new charges

Yeo Jia Wei, the former wealth planner from BSI Bank linked to the widening investigations on 1Malaysia Development Berhad (1MDB), has been slapped with two additional charges in court on May 24.

The 33-year-old, who has been in remand for 38 days, now faces a total of nine charges. The court is now reviewing if he will be granted bail, and will make its decision known on Thursday.

Both the eighth and ninth charge alleged that Yeo, via a vehicle owned by him called Bridgerock Investment Inc, cheated his former employer back in 2013.

Second solicitor general Kwek Mean Luck, in arguing that Yeo should not be granted bail, stressed that Yeo had tried tampering with witnesses. Specifically, on March 27 this year, Yeo met Goh Sze-Wei Samuel and Kevin Michael Swampillai, Yeo’s former manager at BSI, that the time had come to “collaborate” stories to provide a “consistent response” to Commercial Affairs Department (CAD) if questioned.

Harry Elias, founder of the law firm bearing his name, made a rare appearance in court today. He stood in for Philip Fong, who was Yeo’s lawyer. Fong was overseas and couldn’t make it in court today.

He described the 38 days in which Yeo has been in remand as “simply unacceptable”, and offered suggestions that Yeo be allowed bail at an amount ranging from $200,000 to $400,000. He also suggested that Yeo to report to the investigators daily and that he is not a flight risk.

“I’ve not much experience in criminal law, and not much experience in bailing,” says the 79-year-old who has been in practice since 1965. “This is quite possibly the single longest an accused person has been remanded.”

Elias questioned the purpose of such a lengthy period of remand. “It is only to satisfy themselves that they call the shots,” he said, referring to the investigators.

Furthermore, the defence team has only thus far met Yeo for just over an hour. Given the complexity of the case, Elias described that as akin to playing $1 million poker game with only 10 cents in the pocket. “That’s not fair to the system, the accused, the lawyers and the court.”

Elias also took issue with the way Yeo has been described by the prosecution — in tampering with witnesses — as “ever-rampaging”.

In response, Kwek said Elias has “overly dramatised” the risks that Yeo is posing if offered bail. He stressed that Yeo has shown no compunction in perverting justice, having contacted no less than five witnesses on various occasions.

For example, after Yak Yew Chee, the former BSI senior private banker was found to be involved earlier in February, Yeo sent Yak via Telegram, the encrypted messaging system, messages such as: “Why did you do such a stupid thing?”; “What have you gained. You have gained nothing but lose so much”; “Anyway they are very unhappy with you.”

“They”, according to Kwek, are believed to be referring to the BSI clients. “The above communications unmistakably show that the accused has no compunctions perverting the course of justice. He was attempting to influence key witnesses to investigations even before he was formally arrested by the authorities,” added Kwek.

Kwek also referred to an announcement by the Monetary Authority of Singapore (MAS) on May 24 to shut down BSI here for “serious breaches of anti-money laundering requirements, poor management oversight of the bank’s operations, and gross misconduct by some of the bank’s staff.”

That includes Yeo, Yak, and four others: Hans Peter Brunner, the former CEO; Raj Sriram, the former Deputy CEO; Kevin Michael Swampillai, Head of Wealth Management Services and one of whom was named contacted by Yeo; and Seah Yew Foong Yvonne, former Senior Private Banker.

In addition, MAS is already underway in “conducting supervisory reviews of several other financial institutions and bank accounts through which suspicious and unusual transactions have taken place. MAS will not hesitate to take actions against these institutions if they are found to have breached regulations or fallen short of expectations,” the regulator added.

In its statement today, 1MDB “has not been contacted by any foreign lawful authority on matters relating to the company. 1MDB remains committed to fully cooperating” with them.

“The Prosecution is working with the CAD to review the facts presented by MAS. The facts indicate that the accused has played a central part in the activities that has led to the response of the MAS. His deplorable conduct and troubling attempts to tamper with witnesses indicate that releasing him on bail will jeopardise not only CAD’s on-going investigations but also the investigations into the other individuals named in the MAS media release,” said Kwek.

Kwek acknowledged that the investigations are complex. In seeking denial of bail, Kwek said that the prosecution is ready to ask for standalone proceedings, by getting trial on-going for only for certain charges, specifically on the 3rd and 5th charges of tampering with witnesses.

“This is a very serious breach in our financial sector. The reason why we are taking these unusual steps, simply because the accused has taken unusual steps,” he said.

Khir Toyo sudah jatuh ditimpa tangga?

Mahkamah Rayuan pada 30 Mei 2013, mengekalkan keputusan bersalah terhadap bekas Menteri Besar Selangor, Dr Mohd Khir Toyo bagi tuduhan rasuah yang berkaitan dengan pembelian dua lot tanah berharga dan sebuah rumah di Shah Alam, semasa menjadi penjawat awam. Keputusan oleh Mahkamah Rayuan yang diketuai Hakim Datuk Abu Samah Nordin itu dibuat sebulat suara. Panel hakim lain ialah Datuk Azahar Mohamed dan Datuk Aziah Ali. Hakim Azahar, ketika membaca penghakiman itu, berkata mereka mendapati tidak ada keperluan untuk mengganggu keputusan Hakim Mahkamah Tinggi Shah Alam, Datuk Mohtaruddin Baki (kini Hakim Mahkamah Rayuan) apabila beliau menolak semua alasan rayuan yang dikemukakan oleh peguam Khir. “Berdasarkan rekod rayuan, kami berpuas hati untuk menolak rayuan itu kerana kami merasakan bahawa perayu harus didapati bersalah seperti yang didakwa. “Hakim perbicaraan adalah betul untuk mensabitkan tertuduh terhadap pertuduhan melampaui keraguan yang munasabah,” katanya. Khir diwakili oleh Muhammad Shafee Abdullah. Mahkamah Tinggi, pada 23 Disember 2011, menjatuhkan hukuman penjara 12 bulan ke atas khir dan melucuthak harta tersebut. Sudah jatuh ditimpa tangga…

PRU 13 direncana?

Saya melihat keputusan PRU 13 sebagai keputusan di atas sebuah papan catur yang direncanakan. Kemenangan BN dalam PRU 12 dengan kerusi sebanyak 140 dan PR 82 adalah lebih tulen berbanding dalam PRU 13. Perencanaan pengundian dibuat dalam sebuah makmal pengurusan undi (VML – Vote Management Lab) di mana BN diberi kata dua sama ada sedia kalah lebih teruk dan kehilangan Putrajaya atau menerima satu keputusan daripada analisis pakar-pakar perunding yang menawarkan satu angka selesa dan workout dilakukan berdasarkan angka selesa itu. Angka yang dicadangkan ialah PR 89. Menerusi instrumen EPU (Election Planning Unit)VML (Votes Management Lab), MCA dikorbankan utk memberikan kemenangan bergaya kpd DAP sebagai membuktikan wujudnya faktor ‘polarisasi kaum’. Faktor ‘kalimah Allah’ & ‘hukum hudud’ pula diaplikasi utk mengurangkan kerusi PAS. Bagaimanapun, utk menenangkan keadaan kekurangan yang dilakukan di sesuatu tempat perlu ‘digantikan’ dgn kemenangan besar’ di kawasan-kawasan lain… [EndRahman]

DAP Tawar RM5,000?

DAP Perak menawarkan RM5,000 kepada orang ramai yang berjaya membantu polis menangkap dalang yang menyebabkan kebakaran di Bilik Gerakan Barisan Nasional (BN) di Jelapang, baru-baru ini. Setiausaha DAP Perak, Nga Kor Ming berkata, taktik kotor dengan membakar dan meletakkan bom adalah penghinaan kepada demokrasi. Menurutnya, rakyat mahukan pilihan raya yang aman dan beretika agar demokrasi negara ini dihormati serta disegani di dunia. “Semua pihak mengutuk tindakan sedemikian yang sengaja menimbulkan huru-hara. Perkara ini perlu ditegah dan dihentikan dengan segera. Kami sedia menawarkan RM5,000 untuk membantu BN mencari individu yang melakukan perbuatan tidak bertanggungjawab ini,” katanya di Bilik Gerakan Dun Kepayang, semalam. Hadir sama, calon Ahli Parlimen Ipoh Barat, M Kula Segaran. Sebelum ini, dua bilik gerakan BN di Jelapang dibakar dalam kejadian berasingan melibatkan kerosakan peralatan untuk berkempen. Undi Pos Dua Kali?

Kertas undi pos polis yang bersebar di laman sosial memungkinkan pihak berkuasa itu membuang undi sebelum tarikh sebenar pengundian awal pada 30 April ini. Polis dikatakan diarah supaya mula membuang undi pada 23 April 2013 melalui kertas undi yang tertera nombor siri dan logo bendera parti. Kertas undi tersebut turut disertakan dengan borang yang tercatit nama pengundi dan nombor kad pengenalan berserta nombor siri yang sama. Borang tersebut disampulkan bersama kertas undi sebelum digam dan dimasukkan ke kantung undi. Berdasarkan kertas undi itu, dipercayai ia adalah untuk Parlimen P118 Setiawangsa kerana tertera nama calon BN, Datuk Ahmad Fauzi Zahari dan calon KEADILAN, Ibrahim Yaacob. Mengulas perkara ini, Pengerusi Badan Bebas Pemantau Pilihan Raya Malaysia (Mafrel), Syed Ibrahim Syed Noh berkata, jika ia berlaku, pihak terbabit perlu membuat laporan polis dan Suruhanjaya Pilihan Raya (SPR) supaya disiasat. “Tidak sepatutnya berlaku, tapi jika kertas undi sudah diterima dan diminta membuang undi, ia perlu dilapor kepada polis atau SPR kerana kita terima laporan bahawa esok kertas-kertas undi akan dihantar untuk pengundi pos. “Jika ada laporan dibuat berkenaan perkara ini, tetapi mereka tidak mahu ambil tindakan, ia boleh disifatkan sebagai kesalahan besar,” kata Syed Ibrahim kepada Keadilan Daily. Dr M Inginkan Huru-Hara?

Peguam Negara akan dituduh bersubahat jika enggan bertindak ke atas tulisan Tun Dr Mahathir Mohamad yang dilihat boleh mencetus konfrontasi perkauman, kata Naib Presiden PAS, Datuk Mahfuz Omar. Sambil mengecam tulisan Dr Mahathir yang disifatkannya mengapi-apikan perkauman, Mahfuz mendesak Peguam Negara segera mengambil tindakan di bawah Akta Hasutan. Mahfuz memberi jaminan PAS akan berusaha sedaya upaya untuk melindungi dan menjaga keselamatan semua rakyat negara ini jika pihak tidak bertanggungjawab mencetuskan konfrontasi kaum. “PAS bukan sahaja sentiasa berusaha bersungguh-sungguh untuk menghalang percubaan mencetuskan huru-hara akibat sentimen perkauman yang diapi-apikan oleh Umno seperti yang terbukti dalam tulisan Dr Mahathir di dalam blognya yang bertajuk ‘Gelang Patah’. “Malah, kita memberikan komitmen untuk melindungi dan menjaga keselamatan semua rakyat Malaysia, tidak kira Melayu, Cina atau India jika berlaku konfrontasi kaum seperti yang cuba diilhamkan oleh Dr Mahathir di dalam blognya itu,” tegas beliau. Mahfuz menyifatkan tulisan Dr Mahathir itu sebagai satu lagi bukti bahawa beliau berada dalam ketakutan untuk menghadapi kemarahan rakyat terhadap Umno Barisan Nasional (BN) dalam Pilihan Raya Umum Ke-13 pada 5 Mei ini. “Bukan rahsia lagi Dr Mahathir sangat takut menghadapi pilihan raya kali ini malah beliau pernah dilaporkan berkata bahawa beliau lebih bimbangkan keselamatan anak cucunya berbanding keselamatan dirinya sendiri jika Pakatan Rakyat (PR) menang. “Tulisannya itu jelas merupakan usaha terdesak Dr Mahathir untuk menyebarkan ketakutannya itu kepada rakyat dan mengajak rakyat berkongsi ketakutan peribadinya,” kata Mahfuz.

SPR Umum PRU 13: Gendang Perang Bermula?

Suruhanjaya Pilihan Raya (SPR) menetapkan 20 April (Sabtu) sebagai hari penamaan calon manakala pengundian pada 5 Mei (Ahad). Kedua-dua tarikh itu ditetapkan pada mesyuarat khas yang diadakan di Putrajaya pagi tadi. Pengumuman itu dibuat Pengerusi SPR, Tan Sri Abdul Aziz Yusof dalam sidang media hari ini. Bermakna, tempoh kempen PRU13 adalah selama 15 hari, bermula selepas proses penamaan calon dan berakhir pada tengah malam 4 Mei. Menurut Aziz, seramai 13,268,002 layak mengundi dalam Pilihan Raya Umum ke-13. (PRU 13). Tarikh pengundian awal ditetapkan pada 30 April. PRU 13 membabitkan 222 kerusi Parlimen dan 505 kerusi Dewan Undangan Negeri (DUN).Serentak dengan itu, suruhanjaya itu juga memaklumkan calon-calon yang bertanding bolehlah memohon set borang penamaan calon sebanyak RM20 di mana-mana pejabat SPR negeri atau di Putrajaya.
